El Paso Rideshare Injury Attorney For Motor Vehicle Accident Claims

A rideshare crash on I-10, Loop 375 or Mesa Street in El Paso can leave you with injuries, vehicle damage and unexpected medical bills. Who pays for your treatment: the rideshare driver, another motorist or Uber or Lyft’s insurance?

As an El Paso rideshare injury lawyer at the Law Firm of Roberto L. Sanchez, I have spent nearly two decades helping injured people find answers to questions like these. I will explain what to do after a crash, who may be responsible and what compensation may be available.

What To Do After A Lyft Or Uber Accident In Texas?

The first hours after a wreck matter, whether you were a passenger, a driver or in another car. Here are the steps I suggest:

  • Get medical care right away, even if your injuries seem minor.
  • Call 911 so police can create an official crash report.
  • Photograph the scene, your injuries and the vehicle damage.
  • Save your rideshare trip details, including the driver’s name, time and route.

Rideshare apps store detailed trip data, and it can be lost over time. Also, hold off on recorded statements to insurance companies until you have spoken with my firm.

Who Is Liable For A Rideshare Accident In Texas?

The insurance available after a rideshare accident depends on the driver’s status in the rideshare app at the time of the collision:

  • App off: When the driver is offline, Lyft and Uber generally do not provide coverage and claims typically go through the driver’s individual car insurance.
  • App on and awaiting a request: When the driver is logged in and available but has yet to accept a request, Texas law mandates minimum liability insurance of $50,000 for injuries to a person, $100,000 for injuries per crash and $25,000 for damage to property.
  • Trip accepted or passenger onboard: When the driver has accepted a request and is heading to a pickup or carrying a passenger, the rideshare generally provides at least $1 million in coverage for claims made by other parties if the driver is responsible for the crash.

I can help determine which insurance policy may cover your injuries and other losses by identifying the driver’s app status at the time of the crash.

What Compensation Can You Recover After A Texas Rideshare Accident?

Compensation depends on your injuries, the evidence and applicable law. Outcomes vary from case to case. Damages may include:

  • Medical bills, past and future
  • Lost wages
  • Reduced future earning capacity
  • Pain and suffering
  • Disfigurement or impairment
  • Wrongful death damages

Texas follows a modified comparative negligence rule, which allows you to recover compensation if you are 50% or less at fault, though the court will reduce your award by your percentage of responsibility. If you are found at least 51% responsible for the accident, you cannot recover compensation. Under Texas law, you typically have a two-year deadline from the date of the crash to bring a personal injury claim in court. Missing this deadline may prevent you from recovering compensation.
